Condominium Restoration

Several owners have requested self performance in regards to restoring individual condominiums. The vertical and horizontal components of the Association are common elements and thus owned by the membership. In the interest of time and in order to protect the membership of the Bay Water and Villas Condominium Associations, the board of director’s position is aligned with ownership. Through insurance funding and owner assessments the Associations will repair all damaged common elements as identified in the October 30, 2008 Pointe West Blog posting. The following Article from the Declaration of Condominium further addresses this item.

Article 13.6 Prohibition of Damage, Nuisance and Noise
Third Paragraph
No Owner shall do any work which, in the reasonable opinion of the Board or its designee, would jeopardize the soundness or safety of the Condominium or any structure created thereon, would reduce the value thereof, or would impair any easement or other interest in real property thereto, without in every such case the unanimous, prior written consent of all members of the Association and their Mortgagees.
